TAX RELIEF CBDT Circular Guidelines

CBDT Clarifies Section 89(1) Tax Relief on Lump-Sum Salary & DA Arrears: Form 10E Protocol

When government, PSU, or corporate employees receive arrears of salary, retrospective pay fixation under Pay Commissions, or accumulated Dearness Allowance in a lump sum, total taxable income in the year of receipt can push the taxpayer into a significantly higher tax bracket. Section 89(1) of the Income-tax Act provides equitable statutory relief to offset this distortion.

• Step 1: Calculate tax on total income including arrears in the receipt year.
• Step 2: Calculate tax on total income excluding arrears in the receipt year. Difference = [A].
• Step 3: Calculate tax on previous years' income with arrears.
• Step 4: Calculate tax on previous years' income without arrears. Difference = [B].
• Statutory Relief: Relief under Section 89(1) = [A] minus [B] (if positive).
• Mandatory Form 10E: Must be submitted online on the IT portal prior to filing ITR.
